Welcome to The Stick Happens Magnets (“we,” “us,” “our”). By visiting our site and/or purchasing from us, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our website or place an order.

1) Online Store Terms

You agree that you will not use our products or website for any unlawful purpose or violate any laws in your jurisdiction. You must not transmit any harmful code (viruses, malware, etc.) through the site.

2) Products & Custom Orders

Many of our products are custom-made using customer-provided photos and instructions. By placing an order, you confirm you have the right to use any images you upload (see Section 8).

Because custom items are made specifically for you, we cannot guarantee exact color matches. Colors may vary due to screen settings and printing differences.

3) Photo Upload Quality & Printing

You are responsible for the quality of images uploaded. For best results:

  • Upload high-resolution photos
  • Avoid screenshots, heavily zoomed, or blurry images
  • Keep faces and important details centered (square items may crop edges)

If a photo appears extremely low-quality, we may contact you, but we may also print as uploaded if we do not receive a response in time to meet production flow.

4) Pricing, Payment & Taxes

All prices are listed in USD unless stated otherwise. Payment is due at checkout. Sales tax may apply depending on your location and will be calculated at checkout.

5) Processing Time & Shipping

Our tentative processing time is 3–5 business days (may vary by order volume and season). Any shipping or delivery estimates shown at checkout are estimates and do not include processing time.

We are not responsible for shipping delays caused by carriers, weather, customs, or incorrect addresses provided at checkout.

6) Changes, Cancellations & Address Issues

Because custom orders begin production quickly:

  • Cancellations/changes may be requested within 12 hours of purchase, as long as production has not started.
  • Please double-check your shipping address. If an order is returned due to an incorrect address, reshipping fees may apply.

7) Returns, Refunds & Reprints (Custom Items)

Due to the custom nature of our products, we generally do not accept returns or exchanges for:

  • Low-quality, blurry, dark, or pixelated images provided by the customer
  • Customer cropping/positioning issues from the original upload
  • Minor color variation due to screen/print differences
  • Customer-approved instructions (including repeats or photo order)

Damaged or Incorrect Orders

If your order arrives damaged or there is a production error (wrong photo, defect, misprint), contact us within 48 hours of delivery with:

  • Photos of the item(s)
  • Photos of the packaging (if damaged)

If we confirm an issue caused by us, we will offer a reprint or replacement (and in some cases a refund) at our discretion.

8) Customer Content & Copyright

By uploading images, you represent that you own the rights to the content or have permission to use it. You agree not to upload content that infringes copyright, trademark, privacy, or publicity rights.

You grant us permission to use your uploaded content only to produce and fulfill your order. We will not sell your photos.

9) Optional Use of Photos for Marketing

If we ever request to use your finished product photo for marketing (social media/website), we will ask for permission first. (You may opt out anytime.)

10) Accuracy of Information

We try to display product descriptions and pricing accurately, but errors can occur. We reserve the right to correct errors and cancel orders if necessary (with a refund).

11) Third-Party Services

We may use third-party providers (payment processors, shipping carriers, apps) to operate our store. Your use of those services may be subject to their own terms and privacy policies.

12) Limitation of Liability

To the fullest extent permitted by law, The Stick Happens Magnets will not be liable for indirect, incidental, or consequential damages arising from use of our site or products. Our total liability for any claim will not exceed the amount paid for the order.

13) Indemnification

You agree to indemnify and hold us harmless from any claims arising from your breach of these Terms or your uploaded content.

14) Governing Law

These Terms are governed by the laws of the State of Hawaiʻi, United States, without regard to conflict of law principles.

15) Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a new Effective Date.
